Terms and Conditions

  1. ACCEPTANCE OF TERMS
    1. Your access to and use of InstallerPro Forms ("the Website") and the Services outlined in Clause 2, are subject exclusively to these Terms and Conditions. You will not use the Platform/Services for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Platform/Services you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Platform/Services.
    2. InstallerPro Forms reserves the right to update or amend these Terms and Conditions at any time and your continued use of the Platform/Services following any changes shall be deemed to be your acceptance of such change. It is therefore your responsibility to check the Terms and Conditions regularly for any changes.
  2. THE SERVICES
    InstallerPro Forms is a Software as a Service Platform. Following an initial free use period of 14 days users shall be able to purchase blocks of time to access the Platform for their own use. Blocks of time shall be purchased in advance and represent individual, limited periods of contract between InstallerPro Forms and its users as governed by this agreement. There shall be no obligation on the Part of InstallerPro Forms to provide access or services outside or between an individual period of contract. Access to the Platform may be purchased according to the prices published schedule on the platform or website at the time of purchase. These may be for periods of one, three, six or 12 months at a time with charges stated accordingly. InstallerPro Forms, reserves the right to vary these costs from time to time according to its sales policy.
  3. SITE_TITLE is online system for the creation, storage and transmission of engineer visit reports including associated client data generated by the user. SITE_TITLE takes no part in any transactions which may take place between the user and its customers resulting from communication through the Platform. Any exchange of goods or services which result from the use of SITE_TITLE remains the exclusive and private business of the user and its clients. Any claim for services rendered, their quality, efficacy, or fitness for purpose as signified by a visit report or certificate issued by the SITE_TITLE platform, shall remain the sole & exclusive responsibility of the user. SITE_TITLE will not at any time or for any reason participate in dispute resolution between parties. Users shall hold SITE_TITLE, its employees, agents, representatives, owners, shareholders and affiliated organisations harmless in all regards and indemnify them against any claim for compensation or loss, howsoever it may arise.
  4. AGE RESTRICTION
    SITE_TITLE is concerned about the safety of its users, as a result we are unable to accept usership of persons under 18 years of age at this time.
  5. USER ACCOUNT, PASSWORD AND SECURITY SITE_TITLE requires you to open an account. You will be required to complete the registration process by providing certain information and registering a username and password for use with the Services plus additional company information for your business. You are responsible for maintaining the confidentiality of the username and password and also for all activities that take place under your account. You agree to immediately notify SITE_TITLE of any unauthorised use of your password or account or any other breach of security. In no event will SITE_TITLE be liable for any indirect or consequential loss or damage whatsoever resulting from the disclosure of your username and/or password. You may not use another person\'s account at any time. From time to time SITE_TITLE may require you to reset your password. This may be a forced password reset in which you will be asked to change your password to one not previously used or to one which is ‘stronger’.
  6. ACCEPTABLE USE
    1. You acknowledge that all information, text, graphics, logos, photographs, images, moving images, sound, illustrations and other materials ("the Content"), whether posted publicly or transmitted privately, are the sole responsibility of the user from whom such Content originated. SITE_TITLE does not control or endorse the Content and will not be liable in any way for any Content or for any loss or damage of any kind resulting from the use of any Content transmitted via the Services and you agree to bear all risks associated with the use of any Content, including any reliance on the accuracy or completeness of such Content.
    2. In using the Platform/Services you agree not to
      1. post, publish, distribute or disseminate material or information that is defamatory, infringing, obscene, indecent, threatening, abusive, harassing or unlawful;
      2. post, publish, distribute or disseminate material or information that incites discrimination, hate or violence towards any person or group on account of their race, religion, disability, nationality, gender, sexual orientation, or otherwise;
      3. threaten, abuse, disrupt, stalk or otherwise violate the legal rights (including rights of privacy and publicity) of others;
      4. use any information or material in any manner that infringes any copyright, trademark, patent or other proprietary right of any party;
      5. make available or upload files that contain a virus, worm, trojan or corrupt data that may damage the operation of the computer or property of another;
      6. impersonate any person or entity for the purpose of misleading others;
      7. violate any applicable laws or regulations;
      8. use the Platform/Services in any manner that could damage, disable, overburden or impair the Platform/Services or interfere with any other party’s use and enjoyment of the Platform/Services;
      9. post, publish, distribute or disseminate material or information that you do not have a right to transmit under any law or under contractual or fiduciary relationships
      10. attempt to gain unauthorised access to any of the Services, other accounts, computer systems or networks connected to the Platform/Services through hacking, password mining or any other means.
    3. SITE_TITLE has no obligation to monitor the activity of users.
    4. Should users abuse the Platform by any means, break Platform rules or bring the Platform into disrepute by their actions then SITE_TITLE may block their use of the platform at its sole discretion. Users accept the absolute right of SITE_TITLE to do so and by accepting user waive any right of claim against SITE_TITLE for loss in any regard.
  7. CLIENT CONFIDENTIAL DATA
    Users are responsible for compliance with GDPR legislation and shall not use the Platform for the collection or storage of data which they do not have legal permission or valid reason to hold. Where data is stored on the Platform for more than four years, SITE_TITLE may require users to verify that they still have permission to hold such data and do so within the framework of UK law. Users shall wholly indemnify and hold harmless InstallerPro, associate companies, its owners, shareholders, staff and agents against any claim made under GDPR legislation in regard to the storage of data entered by the user on the Platform.
  8. TERMINATION
    SITE_TITLE has the right to terminate your access to any or all of the Services at any time, without notice, for any reason, including without limitation, breach of these Terms and Conditions. SITE_TITLE may also at any time, at its sole discretion, update, amend or discontinue the Platform/Services or any part thereof without prior notice and you agree that SITE_TITLE shall not be liable to you or any third party for any termination of your access to the Platform/Services.
  9. INTERNATIONAL USE
    You agree to comply with all applicable laws regarding the transmission of technical data exported from the United Kingdom or the country in which you reside (if different) and with all local laws and rules regarding acceptable use of and conduct on the Internet.
  10. INTELLECTUAL PROPERTY RIGHTS The Platform and its content (including without limitation the Platform design, text, graphics and all software and source codes connected with the Platform and the Services) are protected by copyright, trade marks, patents and other intellectual property rights and laws. In accessing the Platform you agree that you will access the contents solely for the use intended. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of reports generated by the platform for the purposes of transmission to clients.
  11. INDEMNITY
    You agree to indemnify and hold SITE_TITLE and its owners, employees and agents harmless from and against any breach by you of these Terms and Conditions and any claim or demand brought against SITE_TITLE by any third party arising out of your use of the Services and/or any Content submitted, posted or transmitted through the Services, including without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses) howsoever suffered or incurred by SITE_TITLE in consequence of your breach of these Terms and Conditions
  12. DISCLAIMERS AND LIMITATION OF LIABILITY
    1. To the extent permitted by law, SITE_TITLE will not be liable for any indirect or consequential loss or damage whatsoever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Platform/Services.
    2. SITE_TITLE makes no warranty that the Platform/Services will meet your specific requirements, that the functionality of the Platform/Services will not be uninterrupted from time to time or be 100% error free, that defects will be corrected to you individual satisfaction or that the Platform/Services or the server that makes them available are guaranteed free of viruses or anything else that may be harmful or destructive.
    3. Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of SITE_TITLE for death or personal injury as a result of the negligence of SITE_TITLE or that of its employees or agents.
    4. Nothing in these Terms and Conditions shall affect your statutory rights as a consumer.
  13. SEVERANCE
    If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
  14. GOVERNING LAW
    This Agreement shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
  15. PRIVACY POLICY - DATA PROTECTION ACT
    We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).
    We collect information about you for 2 reasons: firstly, to process your orders and second, to provide you with the best possible service.
    We will not e-mail you in the future unless you have given us your consent.
    We will give you the chance to refuse any marketing email from us or from another trader in the future.
    The type of information we will collect about you includes:
    • your name
    • postcode
    • phone number
    • email address
    We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly.
    The personal information which we hold will be held securely in accordance with our internal security policy and the law and the Which? Web Trader Code.
    If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first.
    We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser.
